These Terms & Conditions govern the access and use of this website and the purchase of agricultural machinery, power weeders, agricultural implements, engines, pumps, spray machines, attachments, accessories, spare parts and related products from CAM Agro.
By accessing the website, creating an account, requesting a quotation, placing an order, making a payment or otherwise purchasing products from CAM Agro, the customer/client acknowledges that they have read, understood and agreed to these Terms & Conditions, the applicable Return & Refund Policy, Shipping Policy, Warranty Terms, Privacy Policy and other policies displayed on the website.
1. DEFINITIONS
For these Terms:
“CAM Agro”, “CAM”, “we”, “us” or “our” means the business/entity operating this website.
“Customer” or “Client” means any individual, business, dealer, distributor, farmer, organisation or other person purchasing products or services from CAM Agro.
“Product” means agricultural machines, power weeders, implements, engines, pumps, attachments, accessories, spare parts and related products sold through the website or through a quotation/order.
“Order” means an order, quotation acceptance, purchase request or other confirmed transaction accepted by CAM Agro.
2. ACCEPTANCE OF TERMS & CUSTOMER'S OWN TERMS
By placing an order or entering into a transaction with CAM Agro, the customer/client agrees that these Terms & Conditions shall govern the transaction unless a separate written agreement has been expressly signed by an authorised representative of CAM Agro.
Any standard terms, purchase conditions or other contractual terms issued by the customer/client, whether contained in a purchase order, email, vendor portal, document or otherwise, shall not automatically apply merely because they were issued before or after these Terms & Conditions.
The customer/client expressly waives and excludes the application of its own standard terms and conditions to the transaction unless such terms have been expressly accepted by CAM Agro in advance and in writing by an authorised representative.
Any deviation, derogation, amendment or exception to these Terms & Conditions shall be valid only where expressly agreed in advance in writing by an authorised representative of CAM Agro.
Silence, failure to object, shipment of goods, acceptance of an order or commencement of performance shall not by itself constitute acceptance of any conflicting customer terms.
Where a separately signed agreement exists between CAM Agro and the customer/client, that agreement shall prevail only to the extent of the specific conflict.
3. PRODUCT INFORMATION
CAM Agro makes reasonable efforts to provide accurate product descriptions, photographs, specifications, dimensions, prices, compatibility information and other product details.
However:
Product photographs may be representative.
Minor differences in colour, graphics, finish, packaging or appearance may occur.
Manufacturers may make technical or design changes.
Accessories shown in photographs are included only where expressly stated.
Specifications may change where the manufacturer makes an improvement or revision.
Product performance can vary according to soil, crop, moisture, terrain, operator skill, maintenance, fuel quality and operating conditions.
The customer is responsible for reviewing the available specifications and compatibility information before placing an order.
4. CUSTOMER RESPONSIBILITY
Before purchasing, the customer must verify, where applicable:
Model and variant
Engine type
Engine power
Dimensions
Shaft diameter
Attachment compatibility
Spare-part number
Fuel requirements
Electrical requirements
Intended application
Required capacity
Required accessories
For technical spare parts, the customer should contact CAM Agro before ordering where compatibility is uncertain.
Ordering the wrong spare part, model or variant due to customer error does not by itself create a right to return.
5. ORDER ACCEPTANCE
An order placed through the website does not necessarily constitute final acceptance until it has been processed or confirmed by CAM Agro.
CAM Agro reserves the right, subject to applicable law, to cancel or reject an order for legitimate reasons, including:
Product unavailability
Pricing or listing errors
Technical errors
Payment issues
Incorrect customer information
Invalid delivery address
Suspected fraudulent activity
Other genuine commercial or operational reasons
Where payment has already been received and CAM Agro cancels the order, the eligible amount will be refunded through an appropriate payment method, subject to applicable law.
6. PRICES, TAXES & PAYMENT
All prices displayed on the website are subject to the information shown at the time of purchase.
Applicable GST, shipping charges, handling charges or other applicable charges may be displayed separately.
For prepaid retail orders, payment must normally be completed before dispatch.
For approved credit, dealer, institutional, wholesale or B2B transactions, the payment terms stated on the relevant invoice, quotation, purchase order or written agreement shall apply.
7. CREDIT / B2B PAYMENT TERMS
For customers to whom CAM Agro has expressly granted credit terms:
Invoices are payable within 21 working days from the applicable invoice date or receipt date, unless a different payment period is expressly stated on the invoice, purchase order, quotation or separate written agreement.
Where another payment timeframe is expressly specified in the applicable transaction documents, that timeframe shall prevail.
If an amount remains unpaid after the applicable due date, CAM Agro may, to the extent permitted by applicable law and the relevant contract, impose a contractual late-payment charge of up to 10% of the overdue amount.
The parties acknowledge that any such charge is subject to applicable law and shall not exceed the amount legally recoverable.
CAM Agro may also suspend further supplies, services, credit facilities, order processing or other performance where payments are overdue, without being required to provide prior warning, to the extent permitted by applicable law and the contractual arrangement.
Suspension shall not release the customer/client from amounts already due.
8. OUTSTANDING AMOUNTS & DEBT RECOVERY
If any payment remains outstanding for more than sixty (60) days after its applicable due date, CAM Agro reserves the right, subject to applicable law, to refer the outstanding account to a debt-recovery agency, collection service or other lawful recovery mechanism.
The customer/client shall be responsible for reasonable recovery costs and legal expenses incurred by CAM Agro in recovering the overdue amount, to the extent legally recoverable and permitted by the applicable contract and law.
Referral to a recovery agency does not prevent CAM Agro from exercising any other lawful contractual or legal remedy.
9. TAX WITHHOLDING / WITHHOLDING AT SOURCE
Where the customer/client is legally required by the applicable law of its jurisdiction to deduct or withhold tax from an amount payable to CAM Agro, such withholding shall be carried out strictly in accordance with applicable law.
The customer/client shall:
Deposit the withheld amount with the relevant tax authority within the legally prescribed period.
Provide CAM Agro with the relevant withholding/TDS certificate and supporting documentation.
Provide CAM Agro with sufficient information to enable it to claim the applicable tax credit or exemption, where available.
Except where a withholding is legally mandatory, the amount invoiced by CAM Agro shall be payable in full.
Where a gross-up arrangement has been expressly agreed in writing, the customer/client shall bear any additional amount required to ensure that CAM Agro receives the agreed net amount, to the extent permitted by applicable law.
CAM Agro shall not be responsible for taxes, charges, duties or costs imposed solely as a consequence of the customer's/client's jurisdiction, tax status or internal compliance obligations, except where CAM Agro is legally responsible for such amount.
10. SHIPPING & DELIVERY
CAM Agro will make reasonable efforts to dispatch and deliver orders within the estimated timeframe communicated to the customer.
Delivery may be affected by:
Transport delays
Weather
Natural disasters
Government restrictions
Strikes
Logistics disruptions
Remote-area transportation
Incorrect address or phone details
Customer unavailability
Force majeure events
Circumstances beyond CAM Agro's reasonable control
For heavy agricultural machinery, specialised transportation and unloading arrangements may be required.
Any additional transportation, unloading, handling or local movement charges not expressly included in the order may be payable by the customer.
11. DELIVERY INSPECTION & UNBOXING EVIDENCE
Customers are strongly advised to inspect the package and product at the time of delivery.
For expensive machinery, engines, pumps and equipment, the customer should make a continuous unboxing/opening video showing the shipping package, shipping label, product, model/serial number and accessories.
Where visible transit damage is found, the customer should immediately notify CAM Agro with photographs/video evidence.
Lack of an unboxing video may make verification more difficult, but shall not by itself remove any statutory right that cannot lawfully be excluded.
12. 30-DAY RETURN POLICY
CAM Agro provides a 30-day return request window from the date of delivery, subject to the conditions of this policy.
The 30-day period is not a 30-day unconditional or no-questions-asked return policy.
Submitting a request within 30 days does not automatically establish return eligibility.
Every return request is subject to review and validation by CAM Agro.
13. ELIGIBLE RETURN CIRCUMSTANCES
A return may be approved after validation primarily where:
13.1 Manufacturing Defect
The product is determined by CAM Agro or its authorised technical/service representative to have a genuine manufacturing defect.
13.2 Incorrect Product Supplied
CAM Agro shipped a materially different product or spare part from the confirmed order.
13.3 Completely Unused Eligible Spare Part
An eligible spare part may be considered for return if it is:
Completely unused
Not installed
Not tested in a machine
Not modified
Not altered
Not contaminated
In resalable condition
Accompanied by all components and documentation
In its original packaging where applicable
Final eligibility is subject to inspection.
14. NO AUTOMATIC RETURN FOR CHANGE OF MIND
The following circumstances generally do not qualify for return:
Customer changed their mind.
Product is no longer required.
Customer ordered the wrong model.
Customer ordered the wrong variant.
Customer ordered an incompatible part.
Customer's crop/soil/field is unsuitable.
Customer expected greater performance than the published specification.
Customer purchased an incorrect product for their application.
Customer found another product at a lower price.
Customer no longer wants the product after delivery.
Product appearance is different from personal expectations despite matching the stated specifications.
15. USED / INSTALLED AGRICULTURAL MACHINERY
Once a machine has been:
Fuelled
Assembled
Installed
Operated
Field-tested
Used
Modified
Repaired
Dismantled
it will generally not be eligible for a discretionary change-of-mind return.
Examples include power weeders, engines, spray machines, pumps, reapers, brush cutters, chaff cutters, cultivators and similar equipment.
Where a used machine is alleged to have a manufacturing defect, the complaint will generally be handled through the applicable technical support, warranty, inspection, repair, replacement or other legally applicable remedy process.
16. NON-RETURNABLE CONDITIONS
A product may be rejected for return where inspection establishes:
Signs of operation or use
Installation or assembly marks
Mud or soil contamination
Fuel contamination
Oil or grease contamination
Water damage
Scratches or dents caused after delivery
Burn or overheating damage
Electrical damage
Broken/tampered seals
Missing components
Missing accessories
Missing labels or serial numbers
Modification
Welding, cutting, drilling or alteration
Unauthorized repair
Improper installation
Incorrect fuel
Contaminated fuel
Incorrect lubricant
Overloading
Abuse or misuse
Accident damage
Normal wear and tear
Failure to follow operating instructions
These exclusions do not override remedies that must be provided under applicable law for genuine defective, deficient, spurious or materially misdescribed goods.
17. SPARE PARTS – STRICT RETURN CONDITIONS
Agricultural spare parts are model and specification sensitive.
Once a spare part has been installed, fitted, tested, operated, modified, lubricated, contaminated or otherwise used, it will generally not qualify for return.
Where a customer receives an incorrect spare part from CAM Agro, the customer must contact CAM Agro before installing or altering the part.
CAM Agro may require photographs, model details, part number, machine details and other evidence before approving the replacement or return.
18. RETURN VALIDATION
No customer should send a product back without obtaining written return approval from CAM Agro.
The return request may require:
Order number
Invoice
Photographs
Video
Product/model number
Serial number
Packaging photographs
Description of the issue
Installation details
Usage details
Other information reasonably required by CAM Agro
CAM Agro may conduct remote troubleshooting or inspection before approving the return.
19. NO UNAUTHORISED RETURNS
Products sent to CAM Agro without prior return authorization may be refused, held pending verification or returned to the customer, subject to applicable law.
Customers must use the return address and shipping method communicated by CAM Agro.
A customer must not independently ship the product to a manufacturer, warehouse, service centre or office unless specifically instructed.
20. TECHNICAL INSPECTION
For machinery and powered equipment, a complaint described as a "manufacturing defect" will be subject to technical assessment.
The assessment may consider whether the problem arose from:
Manufacturing defect
Incorrect assembly
Improper installation
Improper operation
Normal wear
Lack of maintenance
Incorrect fuel
Contaminated fuel
Incorrect oil/lubricant
Overloading
External damage
Modification
Accident
Other customer-related causes
CAM Agro may require physical examination by its technical team, authorised service centre or manufacturer.
21. RETURN SHIPPING
For a validated manufacturing defect or incorrect product supplied by CAM Agro, CAM Agro may arrange or bear appropriate return transportation costs depending on the nature of the product and complaint.
For any customer-requested return that CAM Agro voluntarily approves despite the absence of a manufacturing defect or CAM Agro error, the customer may be responsible for applicable return freight, pickup, handling and transportation costs.
For heavy agricultural machinery, such costs may be substantial.
22. CONDITION OF RETURNED PRODUCTS
An approved return must be received in the condition specified in the return approval.

Accessories
Manuals
Packaging
Labels
Serial numbers
Attachments
Documentation
must accompany the return.
Products must be adequately packaged to prevent damage during return transportation.
Additional damage, missing components or undisclosed use may affect return eligibility or the applicable remedy, to the extent permitted by law.
23. REFUNDS
Refunds are processed only after CAM Agro has completed the applicable validation and inspection process.
Submitting a return request does not itself create a refund entitlement.
Where a refund is approved, it will generally be made through the original payment method or another legally permissible method.
The treatment of shipping, handling, installation, promotional benefits and other charges will depend on the reason for the return and applicable law.
24. REPAIR / REPLACEMENT / REFUND
Depending upon the circumstances, product condition, technical inspection, warranty terms and applicable law, the appropriate remedy may be:

Technical support
Repair
Replacement of a defective component
Replacement of product
Refund
For machinery, technical troubleshooting or repair may be the appropriate first remedy where permitted and practical.
25. WARRANTY
Where a product carries a specific warranty, the applicable warranty period and conditions shall be stated on the relevant product page, invoice, warranty card or accompanying documentation.
Unless otherwise specified, warranty is intended to cover manufacturing defects subject to the relevant warranty conditions.
Warranty generally does not cover:

Consumables
Blades
Belts
Filters
Oils
Lubricants
Spark plugs
Cables
Tyres
Damage caused by misuse
Improper installation
Improper maintenance
Unauthorized modifications
Unauthorized repairs
Incorrect fuel
Contaminated fuel
Incorrect lubricant
Electrical fluctuations
Water damage
Overloading
Accidental damage
Failure to follow operating instructions
Specific product warranty terms shall apply, subject always to applicable law.
26. INSTALLATION & ASSEMBLY
Unless expressly included in the product offering, installation or assembly is not automatically included in the purchase price.
The customer is responsible for ensuring proper installation and assembly unless CAM Agro has expressly undertaken such responsibility.
Incorrect installation, assembly or operation may cause damage and may affect warranty eligibility.
27. PRODUCT USAGE & SAFETY
Agricultural machinery must be operated only for its intended purpose and in accordance with the applicable operating and safety instructions.
The customer is responsible for appropriate operator training, safe operation, maintenance and use of suitable protective equipment.
28. ORDER CANCELLATION
Cancellation requests should be made before dispatch.
Once an order has been dispatched, cancellation may no longer be possible and the customer may need to follow the applicable return process.
Specially procured, customised, assembled, modified or made-to-order products may have additional cancellation restrictions.
29. FAILED DELIVERY / CUSTOMER REFUSAL
Where delivery fails due to:
Incorrect address
Incorrect phone number
Customer unavailability
Refusal to accept delivery
Failure to coordinate delivery
Failure to arrange unloading
Failure to pay applicable charges
Other customer-related reasons
additional transportation, re-dispatch, handling or return-to-origin charges may apply where legally permissible.
30. CAM AGRO'S STANDARD OF PERFORMANCE
CAM Agro shall use reasonable efforts to supply products, process orders and provide applicable support within the timeframes communicated or agreed.
Except where a specific performance, specification, warranty or delivery obligation has been expressly guaranteed in writing, CAM Agro's obligations shall not be interpreted as an absolute guarantee of a particular commercial, agricultural or financial result.
Agricultural results may vary based on field conditions, crop, soil, weather, operator practice, maintenance, fuel quality and other external circumstances.
CAM Agro shall not be responsible for consequences arising from factors outside its reasonable control.
CAM Agro shall not be required to participate as a third party in proceedings or claims brought against a customer/client by that customer's/client's end consumer, except where required by applicable law or expressly agreed in writing.
31. CLAIM NOTIFICATION – COMMERCIAL / B2B TRANSACTIONS
For commercial or B2B transactions, any claim relating to apparent shortage, visible damage, quantity, delivery condition, conformity or other contractual non-conformity should be notified to CAM Agro as soon as reasonably possible.
For contractual commercial claims, the customer/client shall notify CAM Agro by written notice sent by recorded delivery to CAM Agro's registered office within eight (8) days of delivery of the goods or provision of the relevant services, together with sufficient supporting documentation.
For operational efficiency, a copy of the notice may also be sent by email to the designated CAM Agro contact.
This contractual notice procedure shall not be interpreted as extinguishing, restricting or waiving any consumer right, statutory remedy or other right that cannot lawfully be excluded or limited under applicable Indian law.
32. COMMERCIAL LIABILITY
For commercial/B2B transactions, CAM Agro shall not be responsible for indirect or consequential losses to the extent permitted by law, including loss of expected profits, crop loss, business interruption, labour costs, loss of goodwill or other consequential commercial loss, unless such liability is expressly accepted in writing or cannot legally be excluded.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
33. FRAUD, ABUSE & FALSE CLAIMS
CAM Agro may investigate transactions involving suspected:
Fraud
False complaints
Repeated unreasonable returns
Product swapping
Serial-number manipulation
False damage claims
Misuse of warranty
Unauthorized use of promotional offers
Deliberate product damage
Payment abuse
CAM Agro may suspend or restrict transactions where legally permissible.
34. PROMOTIONAL OFFERS
Discounts, coupons, free attachments, free delivery, promotional gifts and other offers may carry specific conditions.
Promotional benefits may not automatically survive cancellation or return.
Where a transaction is returned or cancelled, the applicable promotional benefit will be treated in accordance with the specific offer terms and applicable law.
35. FORCE MAJEURE
CAM Agro shall not be liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, floods, fires, extreme weather, strikes, transport disruptions, government restrictions, shortages, war, civil disturbance, epidemics, technical failures or other force majeure events.
36. INTELLECTUAL PROPERTY
All website content, including trademarks, logos, photographs, product descriptions, videos, graphics, text, designs and other material, is owned by or licensed to CAM Agro unless otherwise stated.
Unauthorised copying, reproduction, modification, distribution or commercial use is prohibited.
37. PRIVACY
Customer information shall be processed in accordance with CAM Agro's Privacy Policy and applicable law.

Customers may contact the designated grievance officer for complaints concerning products, orders, delivery, returns, refunds or other matters.
Complaints will be handled in accordance with applicable law and CAM Agro's internal complaint-resolution process.
39. GOVERNING LAW
All contractual relations between CAM Agro and the customer/client shall be governed exclusively by the laws of India, subject to any mandatory law applicable to the transaction.
Nothing in these Terms shall be interpreted as preventing a consumer from exercising rights before a competent consumer authority/forum where such jurisdiction is available under applicable law.
Subject to mandatory legal provisions, disputes may be brought before the competent courts/authorities having jurisdiction in [City, State, India].
40. SEVERABILITY
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue to apply to the maximum extent permitted by law.
41. AMENDMENTS
CAM Agro may update these Terms & Conditions from time to time.
The updated version shall be published on the website along with the applicable effective date.
42. CUSTOMER ACKNOWLEDGEMENT
By placing an order, requesting a quotation or entering into a transaction with CAM Agro, the customer/client acknowledges that:
Product specifications should be reviewed before ordering.
Spare-part compatibility should be confirmed before installation.
A 30-day return period is not an unconditional return guarantee.
Return requests are subject to validation and, where necessary, technical inspection.
Used, installed, modified or damaged products generally cannot be returned merely due to change of mind.
Products should not be shipped back without return approval.
B2B/credit transactions may be subject to separate payment and commercial terms.
The customer's/client's own standard terms do not apply unless expressly accepted by CAM Agro in writing.
Applicable warranty terms must be followed.
All transactions remain subject to applicable Indian law.
